1. Participants
Anyone who meets the requirements listed in the event descriptions can take part in guided canyoning tours and events from canyoning experience (Reischmann & Klee GmbH). By booking, each participant (even when booked by a third party) ensures that they have the necessary psychological and physical requirements for the activity they have chosen. If the participant's physical or mental condition changes during a tour, it is important to bring this to the attention of one of the guides or group leaders. Any existing health restrictions must be communicated to the event manager without being asked before the campaign begins! Any impairments may lead to the participant being excluded. The effects of certain medications, alcohol or drugs affect the participant and are therefore considered exclusion criteria. In this case, people are excluded from every event and will be treated as a cancellation on the day of the event.
The canyoning tours and activities are carried out exclusively by trained and experienced guides or trainers. Your instructions and requests must be strictly followed. Furthermore, the tour guide of a tour is entitled to exclude people from an action due to disrespect or inappropriate behavior.
Until the start of the campaign, a participant can be represented by any third party, provided that this third party meets the physical and mental requirements (mentioned above). We understand the beginning of the action to be the official greeting of the group by the leading guide. Contractual partners and substitute participants are jointly and severally liable for the event price and any additional costs incurred, provided these can be attributed to the substitute person.
2. General terms and conditions for online voucher purchases
2.1. scope
These General Terms and Conditions are part of the contract for online voucher purchases with canyoning experience and the customer who purchases a voucher via www.canyoning-erleben.de.
2.1.Conclusion of contract | Payment | Delivery
The contract with canyoning is concluded when the order received has been confirmed by us by email. As soon as the fee owed after the contract has been concluded has been received, we will immediately send the ordered voucher in PDF format to the purchaser or a third party specified by the purchaser as the recipient. Before executing the order, the customer must transfer the amount owed. If the voucher ordered online is delivered to the customer but the fee to be paid for it has not been paid, we are entitled to withhold the services documented in the voucher and not to provide them until further notice.
2.3. Limitation of voucher services
Unless otherwise agreed, the vouchers have a validity period of 36 months.
2.4. Right of withdrawal
As a customer, you can revoke your contractual declaration within two weeks in text form (e.g. letter, fax, email) without giving reasons. The period begins at the earliest upon receipt of this instruction. To meet the cancellation deadline, it is sufficient to send the cancellation or the item in a timely manner. 2.4. Exchange of vouchers | Cash payment of vouchers
In the case of vouchers, the service can be freely selected and the difference will be refunded. Cash payment of the voucher value is generally not possible.
2.5. data protection
The customer's data is requested, stored and used as customer data exclusively for processing the order. The basis for this is the relevant data protection regulations of the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG).
3. Conclusion of the contract
By registering, the customer offers the organizer a binding contract. Registration can be made in writing, verbally or by telephone. It takes place for the registrant and also for all participants listed in the registration, for whose contractual obligations the registrant is responsible, as well as for his own obligations, provided that he has accepted this in the registration by an express and separate declaration. The contract is concluded upon acceptance by the organizer. The acceptance does not require any certain shape.
4. Payment
Once you have confirmed your registration in writing, the booking is binding for both parties. A deposit of 20% of the event price is due within 14 days on the invoice received at the same time. The remaining payment is due as agreed in each individual case. If no agreement has been made, the remaining amount is due no later than 14 days before the start of the event.
5. Our services
Unless otherwise agreed, the scope of our offers is determined by the descriptions on our website, our flyers or other advertising materials. With the order confirmation you will receive a list of the services relevant to you and the most important information for a smooth running of the campaign.
We reserve the right to modify the tour or activity due to unforeseen circumstances that could endanger the safety of the participants (e.g. high water levels, sudden changes in the weather, heavy rain, thunderstorms, insufficient skills of the participants, etc.). expand or restrict. The same applies in the event of official arbitrariness, difficulties with local means of transport or comparable unforeseeable circumstances. We are entitled to compensation corresponding to the value of services already provided or still to be provided at the end of the event.
The tours and activities are carried out exclusively by trained and experienced canyoning guides or trainers. Your instructions and requests must be strictly followed. In the event that a participant ends a canyoning tour or action prematurely or has to end it for reasons, the resulting additional costs will be at his own expense.
6. Minimum number of participants
Canyoning tours, activities, courses and events are generally only carried out if the specified minimum number of participants is reached. If not stated, the minimum number of participants is 4 people. If the respective tour description states something different, or if there were individual agreements in advance, these apply. If the desired minimum number of participants is not reached, we are entitled to withdraw from the contract up to 7 days before the start of the campaign or to make an alternative offer regarding the date and the participant amount. Prices already paid can be refunded in full, provided that the lack of participants is not the fault of the participant or booker. Any additional expenses such as hotel costs, vacation days, vaccinations, visas, etc. will not be covered by us under any circumstances.
7. Passport, visa, customs, foreign exchange, health regulations
Each participant is responsible for compliance with the above requirements and regulations; parents are responsible for their children. All disadvantages and costs resulting from non-compliance are borne by the participant. By registering, even if commissioned by a third party, the participant assures that from a medical perspective there are no concerns about his participation in the event and the respective sporting activities. Any costs incurred for vaccinations, visas, etc. will be borne by the participant themselves
8. Service and price changes
Changes or deviations from individual event services from the agreed content of the contract, which become necessary after the contract has been concluded and which we have not made in bad faith, are only permitted if the changes and deviations are not significant and do not affect the overall design of the booked event. The prices printed correspond to the status known at the time of printing. We reserve the right to change the price agreed in the contract accordingly in the event of an increase in transport costs or changes to the exchange rates applicable for the event in question. The images shown on the tours are merely example images that describe the character of the tour and may partly be from other gorges.
9. Photos and videos taken during the tours
Julian Reischmann, Daniel Klee or vicarious agents photograph the participants during the tours. These photos are used and distributed for advertising purposes (print and digital media). In return, we give each participant the opportunity to have the photos from their tour made available to us free of charge. By making a booking, the customer grants Reischmann &Klee GmbH has the right according to §22 KunstUrhG to publicly display the images and distribute them for advertising purposes.
There is no guarantee for the quality or number of photos taken during a tour. No claims can be made in the event of technical defects, including an empty battery, or loss of photos.
10. Withdrawal
Before the event begins, each participant has informed about the event, the course or the Management has the right to withdraw at any time. For reasons of legal certainty, this should be asserted in writing.
In the event of cancellation, we will charge the following percentage compensation based on the total price of the event:
If you cancel up to the 21st day before the start of the event, you will only incur a processing fee of 10 euros per person.
21 - 15 days before the start of the event 25%
14 - 4 days before the start of the event 50%
3 - 1 day before the start of the event 75%
If less than 24 hours before the start of the event, 100% cancellation fees apply.
In the event of a no-show, 100% cancellation fees will automatically apply to the booked services.
Cancellation of appointments with vouchers
For appointments that were made using or with vouchers, the validity of a voucher automatically expires if the guest does not show up. Cancellations will be charged according to the cancellation fees.
11. Liability of the organizer
The organizer is liable within the scope of the duty of care of a prudent businessman. He is obliged to carry out the event in such a way that it has the guaranteed properties and is not afflicted with errors that nullify or reduce the value or suitability for the usual benefit or the benefit provided for in the contract. 12 Limitation of Liability
Participants take part in the canyoning tours AT THEIR OWN RISK.
Our liability for property damage is limited to gross negligence and intent. In the event of personal injury, we are only liable if we are at fault in some way. In this context, point 11 of the General Terms and Conditions should be noted.
13. Obligation to cooperate
If service disruptions occur, the participant is obliged to cooperate within the framework of the legal provisions in order to avoid or minimize any damage.
In particular, the participant is obliged to report his complaint on site and immediately to the guide, leader or trainer. Julian Reischmann or Daniel Klee has commissioned him to remedy the situation, if possible. If the participant culpably fails to report a defect, there will be no claim for a reduction.
14. Increased risk in outdoor sports
We prepare all events, courses and canyoning tours conscientiously. However, we cannot give any guarantee for subjectively imagined event successes. The ones from Reischmann &Activities offered by Klee GmbH have an adventure, (extreme) sport and/or adventure character. Given these risks, participation is AT YOUR OWN RISK. This is not least what makes our tours so special.
For all events, courses and tours, it should be noted that there is an increased risk of accidents and injuries, especially in outdoor sports (danger of falling, avalanches, falling rocks, cold damage, sudden weather, flooding, drowning, possible death, etc.) - this is also due to careful and caring care and preparation by our guides and trainers cannot be completely reduced and eliminated. It should also be noted that in Alpine terrain, especially in remote regions, rescue and/or medical treatment options may only be available to an extremely limited extent due to technical and logistical difficulties. This problem can lead to serious consequences even in the event of minor injuries or incidents. Each participant is expected to have a certain degree of personal responsibility, team spirit, resilience and prudence, as well as an increased willingness to take risks.

15. Invalidity of individual provisions
The ineffectiveness of individual provisions of the General Terms and Conditions does not result in the ineffectiveness of the entire General Terms and Conditions.
16. Place of jurisdiction

We recommend taking out travel cancellation, accident, health, liability, mountain and baggage insurance.
For groups, the booker undertakes to forward all relevant information such as general terms and conditions, tour information and payment information to each participant in the group.
